Smart Life Index is a lead-generation and educational platform designed to connect consumers with licensed, independently contracted insurance professionals. The Site provides:

• Educational content about indexed universal life (IUL) insurance and related financial products;
• Interactive tools, quizzes, and assessments to help users evaluate their potential interest in IUL products;
• A referral service that matches consumers with licensed insurance agents or agencies who may contact the consumer regarding insurance products.

3. Eligibility

To use the Site and submit personal information through our forms, quizzes, or other data-collection mechanisms, you must:

• Be at least 18 years of age;
• Be a legal resident of the United States;
• Have the legal capacity to enter into binding agreements;

• Such contact may occur even if your telephone number is listed on any state or federal Do Not Call registry;
• Your consent is not a condition of purchasing any product or service;
• Message and data rates may apply for text messages;
• You may revoke your consent at any time by contacting us at legal@smartlifeindex.com or by following opt-out instructions included in any communication you receive.

6. Information Sharing with Licensed Professionals

By submitting information through the Site, you understand and agree that:

• These professionals are independent contractors and are not employees, agents, or representatives of Smart Life Index or Appointment House LLC;
• We do not control, supervise, or guarantee the actions, advice, products, or services offered by these professionals;
• Once your information is shared with a licensed professional, their use of that information is governed by their own privacy policies and practices;
• We may share your information with multiple professionals, and you may be contacted by more than one agent or agency;
• We may retain your information in accordance with our Privacy Policy even after sharing it with third-party professionals.

We make reasonable efforts to work with properly licensed and reputable insurance professionals, but we do not guarantee the qualifications, competence, or suitability of any professional to whom your information is provided. You are solely responsible for evaluating and selecting any professional with whom you choose to work.

7. Intellectual Property

All content on the Site -- including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the overall design and layout -- is the property of Appointment House LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

The Smart Life Index name, logo, and all related trademarks, service marks, and trade names are the exclusive property of Appointment House LLC. You may not use, reproduce, modify, distribute, or display any of our intellectual property without our prior written consent.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. This license does not include the right to:

• Reproduce, duplicate, copy, sell, or resell any portion of the Site;
• Use the Site or its content for any commercial purpose without our express written authorization;
• Modify or create derivative works based on the Site or its content;

• Your access to or use of (or inability to access or use) the Site;
• Any conduct or content of any third party on or related to the Site, including the actions of any licensed insurance professional to whom your information is provided;
• Any content, information, or materials obtained from the Site;
• Unauthorized access, use, or alteration of your transmissions or data;
• Any insurance product purchased or applied for as a result of a connection made through the Site.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability shall be limited to the fullest extent permitted by applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Appointment House LLC, its officers, directors, members, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Site or any activity conducted through your submission of information;
• Your violation of these Terms;
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights;
• Any content or information you provide through the Site that is inaccurate, misleading, or fraudulent;
• Any claim that your actions caused damage to a third party.

This indemnification obligation shall survive the termination of these Terms and your use of the Site.

11. Governing Law

These Terms and any disputes arising out of or related to these Terms or the Site shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts. You waive any objection to venue in such courts.

Any claim or cause of action arising out of or related to the Site or these Terms must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred.

12. Modifications

You may discontinue your use of the Site at any time. To request deletion of personal information you have previously submitted, please contact us at legal@smartlifeindex.com. Please note that information already shared with licensed insurance professionals may not be retrievable by us, as those professionals maintain their own records independently.
